These Terms of Use ("Terms") govern access to and use of www.ventist.com, VENTIST CrewBoard at www.ventist.app, VENTIST galleries, and any related pages, digital services, content, features, event tools, or online resources that link to these Terms (collectively, the "Services").
The Services are operated by The Imaji Nation, Branding and Innovation Ltd., trading as VENTIST ("VENTIST," "we," "us," or "our"), located at 7 Barbados Avenue, Kingston, Jamaica.
Please read these Terms carefully. By accessing or using the Services, creating an account, signing in for an event, uploading or submitting content, or otherwise indicating acceptance, you agree to these Terms. If you do not agree, do not use the Services.
Nothing in these Terms excludes or limits any right or remedy that cannot lawfully be excluded under Jamaica's Consumer Protection Act or other applicable law.
1. ABOUT VENTIST AND THE SERVICES
VENTIST is a movement of Christian creatives that trains, equips, and unites people to create positive impact through media, storytelling, innovation, events, and ministry.
The Services may allow users to:
- learn about VENTIST, its mission, events, training, projects, and opportunities;
- view photographs, videos, stories, and creative work;
- create or access a VENTIST CrewBoard account;
- sign in for events and indicate previous or preferred roles;
- provide transportation information for event coordination;
- opt into or out of eligible events;
- view limited crew rosters, team assignments, schedules, or instructions;
- submit applications, messages, feedback, or creative material; and
- access links to third-party galleries, social platforms, partner organisations, or other services.
Features may be added, changed, suspended, or withdrawn from time to time in accordance with these Terms.
2. ELIGIBILITY AND AUTHORITY
You may use the Services only if you can form a legally binding agreement under applicable law.
If you are under 18 or have not reached the age of legal majority where you live, you may use the Services only with the involvement and permission of a parent or legal guardian. A parent or guardian who permits a minor to use the Services is responsible for supervising that use and, to the extent permitted by law, for the minor's compliance with these Terms.
If you use the Services for a church, ministry, company, event organiser, client, or other organisation, you represent that you are authorised to act for that organisation and to bind it to these Terms. In that situation, "you" includes both you and the organisation.
3. ACCOUNTS AND INVITATIONS
Some features require an account or invitation. You agree to:
- provide accurate, current, and complete information;
- maintain the accuracy of your information;
- keep passwords, invitation links, access tokens, and account credentials confidential;
- use only your own account unless VENTIST has expressly authorised shared administrative access;
- notify us promptly if you suspect unauthorised access, loss of credentials, or misuse of your account; and
- accept responsibility for activity conducted through your account to the extent caused by your action, omission, or failure to protect your credentials.
You may not sell, transfer, rent, or give another person access to your account or invitation. Administrative and coordination privileges may be used only for authorised VENTIST purposes.
We may require email verification, password changes, identity confirmation, or other reasonable security steps. We may reject or revoke an invitation, restrict an account, or correct inaccurate account information where reasonably necessary to protect the Services, users, or VENTIST operations.
4. EVENT SIGN-IN AND CREW PARTICIPATION
CrewBoard and related features support event coordination. Signing in, opting into an event, or receiving a proposed role does not guarantee selection, assignment, access, payment, transportation, admission, accreditation, or participation.
Event details—including dates, venues, call times, roles, team assignments, transport arrangements, access requirements, and programme content—may change. You are responsible for reviewing current instructions and arriving prepared and on time.
If you can no longer participate, you should notify the relevant coordinator or opt out as soon as reasonably possible. Transportation information is collected for planning purposes and does not create a guarantee that a ride, parking space, vehicle, or reimbursement will be available.
Unless VENTIST agrees otherwise in writing, participation as a volunteer or community crew member does not create an employment relationship, agency, partnership, joint venture, entitlement to wages, or authority to bind VENTIST. Any paid engagement, independent-contractor arrangement, reimbursement, or employment relationship must be addressed in a separate written agreement.
You agree to follow reasonable event rules, health and safety instructions, venue requirements, safeguarding procedures, production protocols, team-leader directions, and applicable laws. VENTIST may reassign or remove a participant where reasonably necessary for safety, order, performance, safeguarding, or the successful delivery of an event.
5. ACCEPTABLE USE
You must use the Services lawfully, respectfully, and only for their intended purposes. You must not:
- violate any applicable law, regulation, court order, contractual duty, or third-party right;
- impersonate another person or misrepresent your identity, role, authority, experience, or affiliation;
- use another person's account, invitation, event link, or credentials without permission;
- harass, threaten, exploit, defame, discriminate against, or endanger another person;
- submit unlawful, fraudulent, deceptive, obscene, hateful, abusive, or malicious content;
- upload content that infringes copyright, trademark, privacy, publicity, confidentiality, or other rights;
- disclose private crew, client, attendee, or event information without authorisation;
- scrape, harvest, compile, or extract names, photographs, roster information, contact details, or other data from the Services;
- use photographs, video, or roster information for facial recognition, biometric analysis, surveillance, identity profiling, or unauthorised artificial-intelligence training;
- introduce malware, harmful code, automated traffic, or any technology intended to disrupt or compromise the Services;
- probe, scan, test, bypass, or defeat security, authentication, access controls, rate limits, or technical protections;
- reverse engineer or attempt to obtain source code except to the limited extent such a restriction is prohibited by law;
- use bots, crawlers, scripts, or automated tools without our written permission, except standard search-engine indexing that respects our technical instructions;
- interfere with another person's use of the Services or place an unreasonable burden on our systems;
- use the Services, VENTIST name, or VENTIST community to send spam, unauthorised promotions, pyramid schemes, or misleading solicitations;
- collect money, advertise services, recruit members, or represent an activity as endorsed by VENTIST without written permission; or
- use the Services or their content to develop a competing gallery, roster, event-management database, or commercial dataset without written permission.
An attempt to perform a prohibited act is itself a breach of these Terms.
6. INTELLECTUAL PROPERTY
The Services and their content—including the VENTIST name and logos, site design, text, graphics, photographs, videos, audio, training material, event concepts, software, databases, selection and arrangement of content, and other materials—are owned by or licensed to VENTIST and are protected by copyright, trademark, and other applicable laws.
Subject to these Terms, VENTIST grants you a limited, personal, revocable, non-exclusive, non-transferable licence to access and use the Services for their intended, lawful, non-commercial purposes. No ownership right is transferred to you.
Unless VENTIST or the relevant rights holder gives prior written permission, you may not reproduce, modify, publish, distribute, sell, license, publicly perform, publicly display, create derivative works from, remove ownership notices from, or commercially exploit any part of the Services.
Downloading, sharing, or reposting content is permitted only where the Services expressly provide that function, where a separate client or contributor agreement authorises it, or where applicable law permits it. Any permitted use must preserve credits, watermarks, copyright notices, and the integrity of the work.
VENTIST and related branding may not be used in a manner that suggests sponsorship, partnership, certification, or endorsement without our prior written approval.
7. PHOTOGRAPHS, VIDEO, AUDIO, AND EVENT MEDIA
VENTIST events and activities may be photographed, filmed, recorded, livestreamed, or otherwise documented. Event-specific notices, tickets, registration forms, model releases, performer agreements, client agreements, or venue rules may contain additional media terms. Those specific terms apply in addition to these Terms and will control if there is a direct conflict concerning the relevant media.
Unless a download, licence, or written agreement states otherwise, content in a VENTIST gallery is provided for viewing only. The presence of a person's image in a gallery does not give that person—or anyone else—copyright ownership or unrestricted permission to copy, edit, sell, commercially publish, train an artificial-intelligence system with, or otherwise exploit the image.
You may request review of a photograph, video, or other content featuring you if you have a reasonable privacy, safety, safeguarding, or legal concern. Contact yorkali@theimajination.com and identify the content and concern. VENTIST will assess the request fairly, taking account of applicable law, contractual rights, public interest, legitimate archival or documentary purposes, and the rights of others.
8. USER CONTENT AND SUBMISSIONS
"User Content" means photographs, video, audio, text, comments, testimonials, portfolio work, designs, project material, feedback, or other content you submit, upload, display, or provide through the Services.
You retain any ownership rights you already hold in your User Content. You represent and warrant that:
- you own the User Content or have all permissions required to submit it;
- the User Content and our permitted use of it will not infringe another person's rights;
- all required permissions from identifiable people, performers, contributors, clients, venues, or rights holders have been obtained; and
- the User Content is accurate where it states facts about other people or organisations.
By submitting User Content, you grant VENTIST a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, adapt for technical or layout purposes, display, communicate, and distribute that content only as reasonably necessary to:
- operate and provide the Services;
- administer the project, event, training activity, or submission for which it was provided;
- protect, troubleshoot, or improve the Services; and
- document or promote the relevant VENTIST activity where that promotional use was reasonably disclosed, expected from the context, or separately authorised.
This licence permits VENTIST to use service providers acting on our behalf and to create technically necessary copies, thumbnails, crops, or format conversions. It does not transfer your ownership to VENTIST.
Where a separate contributor, photography, production, model-release, performer, client, or licensing agreement applies, that agreement will govern the relevant content and will control over this section if there is a conflict.
You may request removal of User Content, but removal may not be immediate or complete where the material has already been lawfully published, incorporated into completed work, shared under a valid agreement, retained in backups, or must be preserved for legal, accounting, security, or archival reasons.
9. FEEDBACK AND IDEAS
If you voluntarily send general suggestions or feedback about the Services, you permit VENTIST to use that feedback without payment or restriction. This does not apply to confidential proposals, commissioned work, or intellectual property governed by a separate written agreement.
Do not send confidential business ideas, scripts, treatments, brand concepts, or other proprietary material unless VENTIST has agreed in writing to receive it confidentially.
10. PRIVACY
Our Privacy Policy explains how VENTIST collects, uses, stores, shares, and protects personal data. It forms part of the framework governing your use of the Services. By using the Services, you acknowledge that personal data will be handled as described in the Privacy Policy and applicable law.
If these Terms and the Privacy Policy conflict on a matter concerning personal-data handling, the Privacy Policy will control for that matter.
11. THIRD-PARTY SERVICES AND LINKS
The Services may link to or integrate with external galleries, cloud services, social networks, video platforms, churches, ministries, venues, event partners, payment providers, or other third-party services.
VENTIST does not control third-party services and is not responsible for their availability, security, content, terms, privacy practices, or transactions. A link does not necessarily constitute endorsement. Your use of a third-party service is governed by that third party's terms and policies.
12. TRAINING, TICKETS, PRODUCTS, AND PAID SERVICES
VENTIST may offer paid training, event tickets, creative services, products, subscriptions, or other transactions. Prices, payment terms, deliverables, eligibility requirements, refund or cancellation rules, and any other transaction-specific terms will be disclosed at the point of purchase or in a separate agreement.
Where transaction-specific terms conflict with these Terms, the transaction-specific terms will control for that transaction. Nothing in these Terms limits any non-excludable consumer right or remedy.
Unless otherwise stated, you are responsible for any internet, device, travel, accommodation, or other third-party cost associated with accessing the Services or attending an event.
13. SERVICE AVAILABILITY AND CHANGES
We aim to keep the Services useful and available, but we do not guarantee uninterrupted, error-free, or permanent access. Maintenance, security incidents, provider outages, internet failures, event changes, technical faults, legal requirements, or circumstances beyond our reasonable control may affect availability.
We may add, remove, redesign, suspend, restrict, or discontinue any feature. Where reasonably practicable, we will provide notice of a material change that significantly affects registered users.
You are responsible for keeping copies of User Content or information that you need. The Services should not be treated as your sole archive, backup system, emergency communication channel, or guaranteed source of event instructions.
14. SUSPENSION AND TERMINATION
You may stop using the Services at any time. You may request account closure using the contact details below, subject to lawful record-retention requirements.
VENTIST may restrict, suspend, or terminate access where we reasonably believe that:
- you have breached these Terms or applicable law;
- your account or activity creates a security, safety, legal, safeguarding, or operational risk;
- your account is being used fraudulently or without authority;
- suspension is necessary to protect another person, VENTIST, or a third party;
- an event, programme, relationship, or relevant part of the Services has ended; or
- we are required to do so by law or a competent authority.
Where appropriate and lawful, we may provide notice and an opportunity to correct the issue. Serious, repeated, fraudulent, dangerous, or unlawful conduct may result in immediate action.
Sections that by their nature should continue—including intellectual-property provisions, licences already granted where continued use is necessary, disclaimers, liability provisions, dispute terms, and accrued rights—survive termination.
15. DISCLAIMERS
The Services are provided on an "as available" basis. To the fullest extent permitted by law, VENTIST does not promise that the Services will always be available, secure, complete, accurate, current, or free from errors or harmful components.
Information provided through the Services is general and may change. It is not legal, financial, medical, safety, employment, or other professional advice. Event schedules, assignments, transport plans, opportunities, and third-party information should be independently confirmed where important.
Nothing in this section excludes a warranty, representation, duty, right, or remedy that cannot lawfully be excluded.
16. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, death or personal injury caused by negligence where such liability cannot lawfully be excluded, breach of a non-excludable statutory duty, or any other liability that applicable law does not permit us to exclude or limit.
Subject to the paragraph above, and to the fullest extent permitted by law:
- VENTIST will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss; loss of profit, revenue, opportunity, goodwill, reputation, anticipated savings, or data; or loss resulting from a third-party service;
- VENTIST will not be liable for a failure or delay caused by events beyond its reasonable control; and
- where liability arises from a paid service, VENTIST's aggregate liability arising from that service will not exceed the amount you paid VENTIST for that specific service during the six months immediately preceding the event giving rise to the claim.
The financial cap above does not apply where it would deprive a consumer of a remedy guaranteed by applicable law. For a free Service, and where a monetary cap is legally permitted, VENTIST's aggregate liability will not exceed J$25,000.
17. RESPONSIBILITY FOR CLAIMS CAUSED BY YOUR CONDUCT
To the extent permitted by law, you are responsible for losses, liabilities, damages, and reasonable costs directly resulting from your unlawful use of the Services, material breach of these Terms, infringement of another person's rights, or User Content you submitted without the required rights or permissions.
VENTIST will give you reasonable notice of a third-party claim for which it seeks recovery under this section and will not settle the claim in a manner that imposes an admission of wrongdoing or non-monetary obligation on you without your consent, which will not be unreasonably withheld.
This section does not require an individual consumer to indemnify VENTIST for loss caused by VENTIST's own negligence, breach of law, or wrongful conduct.
18. REPORTING CONCERNS
To report suspected account misuse, unlawful content, copyright infringement, a security issue, or a breach of these Terms, email yorkali@theimajination.com.
Your report should identify the relevant content, account, event, or URL; explain the concern; state the basis of any rights you claim; and provide reliable contact information. We may request reasonable supporting information before acting.
Knowingly submitting a false, deceptive, or abusive report may itself violate these Terms or applicable law.
19. GOVERNING LAW AND DISPUTES
These Terms and any non-contractual dispute arising from the Services are governed by the laws of Jamaica, without regard to conflict-of-law principles.
Before commencing court proceedings, you and VENTIST should make a reasonable good-faith effort to resolve the dispute through written communication. Send a notice describing the dispute and requested resolution to yorkali@theimajination.com or to the postal address in section 23. This requirement does not prevent either party from seeking urgent injunctive relief, reporting a matter to a regulator, exercising a statutory consumer right, or filing a claim before a limitation period expires.
Subject to any right you have to bring a claim elsewhere under mandatory consumer law, the courts of Jamaica will have non-exclusive jurisdiction over disputes relating to these Terms or the Services.
20. CHANGES TO THESE TERMS
We may update these Terms to reflect changes in the Services, law, security requirements, or our operations. The updated Terms will be posted through the Services with a revised effective date.
Where a change materially affects registered users' rights or obligations, we will provide reasonable additional notice when practicable. Changes will apply prospectively from the stated effective date unless an earlier application is required by law. Continued use after the effective date constitutes acceptance of the updated Terms.
21. ELECTRONIC COMMUNICATIONS
You agree that notices, account communications, event information, and other records may be provided electronically, including by email, through CrewBoard, or by posting through the Services, where permitted by law. You are responsible for maintaining a current email address and reviewing communications relating to your account or event participation.
Electronic acceptance, records, and communications will have the effect given to them under Jamaica's Electronic Transactions Act and other applicable law.
22. GENERAL TERMS
Entire agreement. These Terms, the Privacy Policy, and any applicable event-specific, transaction-specific, or separately signed agreement form the agreement governing the relevant use of the Services.
Order of precedence. A separately signed agreement or expressly accepted transaction-specific term controls over these Terms to the extent of a direct conflict concerning its subject matter. The Privacy Policy controls on personal-data handling.
Severability. If a court or competent authority finds part of these Terms unlawful or unenforceable, that part will be adjusted or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.
No waiver. A failure or delay in enforcing a provision is not a waiver of that provision or any other right.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our written consent. VENTIST may transfer these Terms as part of a legitimate reorganisation, merger, sale, or transfer of its operations, provided that your non-excludable rights are not reduced.
No third-party beneficiaries. Except where these Terms expressly state otherwise, they do not give enforcement rights to a person who is not a party to them.
Headings. Section headings are provided for convenience and do not affect interpretation.
